As of early 2025, the scope of OFCCP enforcement has significantly changed. Race- and sex-based affirmative action requirements under Executive Order 11246 have been revoked and are no longer enforced. However, OFCCP continues to enforce protections for individuals with disabilities and protected veterans under Section 503 and VEVRAA.

For BrightMove customers, this means reduced audit exposure, but continued compliance obligations related to disability and veteran nondiscrimination.

EEOC, Veteran, and Disability Disclosures in BrightMove

BrightMove supports configurable EEOC, veteran, and disability self-identification questions that may be required based on a customer’s hiring practices, contractual obligations, or regulatory environment.

While the Office of Federal Contract Compliance Programs (OFCCP) historically administered certain affirmative action enforcement programs, EEOC data collection and nondiscrimination requirements remain relevant for many organizations, regardless of OFCCP enforcement changes.

What This Means for BrightMove

As the regulatory landscape evolves, BrightMove adapts to ensure continued support for compliant hiring practices. We continue to support EEOC-driven candidate disclosures and self-identification workflows through configurable portal and client-level settings.

To better reflect the broader use of these features and reduce reliance on agency-specific terminology, BrightMove is transitioning away from the “OFCCP” module name. Going forward, this functionality will be referred to as Fair Hiring Controls.

This is a naming update only. All existing behaviors, configuration options, and supported workflows remain unchanged. This reflects our current approach in response to recent federal changes. BrightMove will continue to adapt as needed, and this page will serve as a reference for any future updates. Please check back periodically for the latest information.

We plan to update the labels for OFCCP-related buttons and features in early 2026.

Company-Level EEOC Settings

EEOC-related questions are managed at the company level and control which self-identification questions appear on candidate application portals.

Navigate to Settings > Company Preferences. In the Portal section, the following options are available:

  • Show EEOC for Online Application
    Displays race and gender questions on the candidate portal.

  • Show EEOC – Vet Status (Show EEOC must be active)
    Displays the pre-offer veteran status question to candidates.

  • Show EEOC – Disability Status (Show EEOC must be active)
    Displays the disability self-identification question to candidates.

  • Describe Disability and Veteran Criteria
    Displays additional “More info” text explaining veteran and disability classifications, including applicable form language.

Note: When Fair Hiring Controls (still currently labeled OFCCP) is enabled at the company level, candidate profile Gravatar images are not displayed.

Client-Level EEOC Overrides

If EEOC fields are disabled at the company level, override options become available on individual Client profiles. This allows organizations to:

  • Keep EEOC questions hidden by default

  • Enable them only for specific clients where disclosures are required

To manage overrides, edit the Client profile and select the appropriate options:

  • Override Portal EEOC
    Displays race and gender questions for that client.

  • Override Veteran Status
    Displays the pre-offer veteran status question for that client.

  • Override Disability Status
    Displays the disability self-identification question for that client.

If these options are not visible, the corresponding setting is already enabled at the company level.

How Does BrightMove Know If My Company Wants to Use Fair Hiring Controls?

BrightMove does not automatically determine whether your organization requires or prefers these features.

To enable Fair Hiring Controls, you must notify your BrightMove representative. There is no way for BrightMove to know that you need access to this module unless you request it.
